By accessing or using the TBioScan® platform (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must refrain from using the Platform and our services. If you use the Platform on behalf of a clinic, practice, or law firm, you represent that you are authorized to bind that organization to these Terms.

2. Description of Services

TBioScan® provides a diagnostic platform for objective blood biomarker testing related to traumatic brain injury (TBI). Through the Platform, partner clinics order tests and submit specimens, our laboratory performs the analysis, and reports are delivered electronically to authorized recipients.

To ensure transparency with our payment processor and users, we adhere to the following policy:

Cancellations (Within 72 Hours): You may cancel an order for a full refund within 72 hours of placing it, strictly provided that the test requisition has not yet been utilized and no specimen has been collected.

Non-Refundable Events: Once a specimen has been collected (e.g., a blood draw) or a test has been processed by the laboratory, all sales are final and non-refundable.

Dispute Resolution: If you believe a charge was made in error, please contact our support team using the details below before initiating a chargeback with your bank.

6. Medical and Regulatory Disclaimer

Reports provided through the Platform are for informational purposes and clinical decision support. You should not use this information to diagnose or treat a health problem without consulting a qualified healthcare provider. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition or your results.

Regulatory note: TBioScan® is a Laboratory-Developed Test (LDT) developed and validated by BioCentra®, a CAP-accredited, CLIA-certified high-complexity laboratory. This test has not been cleared or approved by the U.S. Food and Drug Administration. Results are intended to support, not replace, clinical judgment.

7. Use in Legal Proceedings

Reports may be used to support documentation in legal matters. However, TBioScan® makes no representation or warranty regarding the admissibility of any report in any court or proceeding, or regarding the outcome of any claim, settlement, or litigation. Responsibility for the use of a report in a legal matter rests solely with the retaining party and its counsel.

8. User Conduct and Accuracy

You agree to provide accurate, current, and complete information during intake, ordering, and onboarding. Placing orders under false identities, submitting specimens under a false identity, or using fraudulent payment information is strictly prohibited and may result in immediate termination of service and legal action. You agree to safeguard your account credentials and to notify us promptly of any unauthorized use.

9. Confidentiality and Health Information

Our collection and handling of Protected Health Information is described in our Privacy Policy and governed by HIPAA. Clinicians, clinics, attorneys, and firms receiving health information through the Platform agree to use it solely for the authorized purpose for which it was disclosed and to protect it from further unauthorized disclosure.

10. Intellectual Property

The Platform, the TBioScan® and BioCentra® names and marks, report formats, and all related content are the property of their respective owners and are protected by law. No license is granted except as necessary to use the services as intended.

11. Limitation of Liability

To the fullest extent permitted by law, TBioScan® shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

We may suspend or terminate access to the Platform for violation of these Terms, suspected fraud, or as required by law or regulatory obligation. Provisions that by their nature should survive termination — including confidentiality, disclaimers, and limitations of liability — survive.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, Harris County, without regard to its conflict of law provisions.
